1. Agreement to Terms

By accessing or using CronPing ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and CronPing ("we", "us", "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

CronPing provides cron job monitoring services that allow you to:

• Monitor scheduled tasks (cron jobs, background jobs, scheduled scripts)
• Receive alerts when monitors fail or become unavailable
• Track monitor uptime and downtime statistics
• Integrate with third-party services (Slack, Discord, email, SMS, webhooks)
• Access status pages and analytics

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to use CronPing. By registering, you represent that you are of legal age and have the authority to enter into this agreement.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• We reserve the right to terminate accounts that violate these Terms

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.

4. Acceptable Use Policy

4.1 Permitted Use

You may use CronPing for lawful purposes related to monitoring your own cron jobs, scheduled tasks, and background processes.

4.2 Prohibited Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts or bots to abuse the Service
• Send excessive ping requests to overload our servers (rate limits apply)
• Monitor systems you do not own or have permission to monitor
• Use the Service to spam, harass, or send unsolicited communications
• Resell or redistribute the Service without our written permission
• Remove or obscure any copyright, trademark, or proprietary notices

4.3 Rate Limits

The Service is subject to rate limits to ensure fair use. Excessive use may result in temporary or permanent suspension of your account. Current rate limit: 100 pings per minute per IP address.

5. Plans and Pricing

5.1 Free Plan

We offer a free plan with limited features. The free plan may be modified or discontinued at any time with 30 days' notice.

5.2 Paid Plans

Paid plans are billed monthly or annually in advance. Pricing is available on our Pricing Page.

• Payments are processed securely through Stripe
• All fees are in USD unless otherwise stated
• Prices are subject to change with 30 days' notice
• You authorize us to charge your payment method for recurring subscriptions

5.3 Lifetime Deals (LTD)

Lifetime deal purchases are one-time payments that grant perpetual access to the Service at the tier purchased. Lifetime deals are non-refundable except as required by law. We reserve the right to modify features or limits of lifetime plans with 90 days' notice.

6. Billing and Refunds

6.1 Billing Cycle

Paid plans are billed on a monthly or annual cycle. Your billing cycle begins on the date you subscribe and renews automatically unless canceled.

6.2 Payment Failures

If your payment fails, we will attempt to charge your payment method up to 3 times. If payment continues to fail, your account may be downgraded to the free plan or suspended.

6.3 Refunds

We offer a 30-day money-back guarantee for first-time monthly subscriptions. To request a refund, contact us at billing@cronping.io within 30 days of your first charge.

Refunds are not available for:

• Renewal charges after the first billing cycle
• Lifetime deal purchases (except as required by law)
• Accounts terminated for Terms violations

6.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing cycle. You will retain access until the end of the paid period. No refunds are provided for partial billing periods.

7. Intellectual Property

7.1 Our Rights

All content, features, and functionality of the Service (including but not limited to software, text, graphics, logos, and design) are owned by CronPing and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain ownership of any data you submit to the Service (monitor configurations, alert settings, etc.). You grant us a license to use, store, and process this data solely to provide the Service.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or attribution.

8. Service Availability

8.1 Uptime Commitment

We strive to maintain 99.9% uptime for paid plans. However, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Maintenance

We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without notice. We will make reasonable efforts to minimize downtime.

8.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide 30 days' notice for significant changes to paid plans.

9. Limitation of Liability

9.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRONPING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

9.3 Maximum Liability

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless CronPing from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect and process data as described in our Privacy Policy
• You are responsible for ensuring your use complies with data protection laws
• We may use aggregated, anonymized data for analytics and service improvement

12. Termination

12.1 By You

You may terminate your account at any time from your account settings. Upon termination, your data will be deleted within 30 days (excluding billing records required by law).

12.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay for paid plan services
• Abuse the Service or harm other users

12.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. All provisions of these Terms that should survive termination shall survive, including intellectual property rights, limitation of liability, and dispute resolution.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal claim, you agree to contact us at legal@cronping.io to attempt to resolve the dispute informally.

13.2 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis only, and not as part of a class, consolidated, or representative action.

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CronPing regarding the Service.

14.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
